Relationship between the State and Ecclesiastical Authority in cases of child abuse by clerics

Abstract
In the relations between canonical and state legislation regarding crimes of pedophilia, delicate relations of mutual dependence arise: in fact, if the State is responsible for prosecuting and repressing the crimes provided for in its own system, the Church’s right to judge autonomously in cases in which these crimes involve clerics must also be considered. Does the current canonical legislation allow for this autonomy of judgment to be guaranteed, or will we always have to witness the widespread custom of deferring the power to control and investigate the crimes committed by our ministers wholly to state bodies, without intervening in any way?
